Texas Senate Bill 3: What It Means—and Why We’re Still Shipping
Big news just broke out of Texas. On May 22, 2025, the Texas House passed Senate Bill 3 (SB3), a piece of legislation that, if signed into law, could ban the sale and possession of any hemp product containing more than 0.3% total THC in the state. That includes THCa flower.
The Texas Senate concurred with the House amendments on May 25, 2025, and the bill is now awaiting action from Governor Greg Abbott. If signed, the law would go into effect September 1, 2025.
Let’s be clear: This is a major threat to the hemp industry in Texas. It’s also a threat to the many Texans who rely on this plant for pain relief, peace of mind, sleep, appetite, and the ability to show up in their lives as their full selves.

What SB3 Actually Says
SB3 adds new restrictions on hemp-derived cannabinoids and defines illegal products as anything with more than 0.3% total THC—not just Delta-9. This means even federally legal hemp flower (which may be rich in non-psychoactive THCa) would be banned.
The bill passed both the Texas House and Senate and now sits on Governor Abbott’s desk. If signed, it would criminalize possession of certain hemp products—even if they contain less Delta-9 than federally allowed.
We’re Still Shipping to Texas—For Now
We want to be transparent. Right now, Lucky Elk will continue to ship to Texas. Nothing has changed yet. And we’ll continue to serve our Texas customers with care, clarity, and respect—just like we always have.
